We welcome you to join our agile and growing Pricing & Contracts team at Philips Volcano. As an experienced Commercial Contracts Manager, this internal and external customer facing role, will allow you to primarily create, review, revise, and independently negotiate a wide range of agreements to support both established complex business and advise on contract fundamentals for new models for sales organizations in less mature markets. The successful hire must have experience in pricing products and services and contracting using a variety of consideration levers, volume-based discounts, quantity or revenue tier thresholds, rebates, value add solutions and third party fee arrangements.

In this role, you have the opportunity to

Collaborate with internal customers in all functions (sales, finance, legal, product marketing, order fulfillment, installations, compliance, field service, etc.) to develop lean business processes for ongoing contract development and management. The role requires the Contracts Manager to be flexible and hands-on to work with and coach clinical sales management and commercial contracts team members to ensure success with the ability or former/current experience supervising and coordinating efforts of one or more personnel from different areas. The manager must have the skill set and proven track record of developing contracts from business concept to revenue generating agreements. The role also requires the manager to appreciate the value of data and the dependent relationship between valid data and business decisions and to work closely with sales analysts to operate the businesses.

You are responsible for (but not limited to)

  • Creating, reviewing, analyzing, guiding and approving commercial contracts and sales agreements for US based sales team organizations, hospitals, office-based labs, IDN and GPO customers. Independently draft, redline and negotiate substantive legal and commercial terms of capital, software, cross-channel, single-use device, utilization, maintenance and hybrid agreements.

  • Assist the businesses in monitoring contract compliance to ensure adherence to their respective obligations.

  • Collaborating with relevant stakeholders, review agreements for accuracy, legality and conformity to business standards and refer legal issues to attorneys for review and direction, as needed.

  • Being a self-starter who is able to own and resolve problems, operate independently, and expeditiously provide sound recommendations consistent with good business practices and common sense.

  • Identifying modifications and evaluating various contract templates for compliance with evolving business, legal or regulatory requirements.

  • Evaluating and coordinating the completion of large-scale national Requests for Proposals (RFPs) across multiple sales divisions, with responsibilities to compile product disclosures and model pricing options and analytics.

  • Identifying requirements of contracts and amendments. Communicate clearly and obtain buy-in and approvals per stipulations in proposed contracts and within company policies.

  • Acting as a liaison between sales, operations, finance, legal and order fulfilment departments to ensure proper treatment of single sales transactions and ongoing management of national and regional contracts.

You will be…

Reporting to the Manager, Pricing & Contracts in our Alpharetta, Ga office and act as a liaison between sales, operations, finance, legal and order fulfilment departments to ensure proper treatment of single sales transactions and ongoing management of national and regional contracts.

To succeed in this role, you will have the following skills and experience:

  • Bachelor’s Degree, required (at a minimum); Master’s degree, plus.

  • 6+ years medical technology or devices commercial contracting experience to include practical customer facing knowledge reviewing, redlining and negotiating substantive external legal and commercial contract terms within established profiles.

  • 3+ years supporting clinical sales teams in day to day contract formation, ongoing management of agreements and new product go-to-market contracts. Meticulous attention to detail and pride in the quality of work product, with a demonstrated track record of disciplined execution and exceptional communication and organization skills.

  • 8+ years medical technology or devices commercial contracting experience, ideal

  • Experience and understanding of GAAP revenue recognition guidelines of capital hardware, software and extended service sales agreements. Advanced proficiency in Word, PowerPoint and Outlook. Intermediate proficiency in Excel.

  • Working knowledge of Federal Acquisition Regulations (FAR), the Department of Defense supplement to the FAR (DFARS), Contracts/Subcontracts terminology; as well as, business practices and approvals per stipulations in proposed contracts and within company policies - bonus

  • Act as a liaison between sales, operations, finance, legal and order fulfilment departments to ensure proper treatment of single sales transactions and ongoing management of national and regional contracts.

  • Lead and conduct negotiations with minimal supervision to reduce business, financial and legal risk.

  • Have a sense of humor with the skills to fit into a hard working but sociable environment.

  • Advanced proficiency in MS Excel.
